Terms of Service

These Terms of Service ("Terms") govern your access to and use of Homeward at homeward.casa ("Homeward," "we," "us," or "our"). By accessing or using Homeward, you agree to these Terms. If you do not agree, do not use the service.
1. What Homeward provides
Homeward helps you evaluate whether a home address may fit your daily life by generating informational fit reports based on the address and preferences you provide. Reports may include nearby amenities, travel summaries, lifestyle tradeoffs, verification notes, maps, and plain-language summaries derived from third-party data and automated analysis.
Homeward is intended to support move planning and personal research. It is not a substitute for professional real estate, legal, financial, medical, educational, or relocation advice.
2. Eligibility
You must be at least 13 years old to use Homeward. If you are using Homeward on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Accounts and sign-in
Certain features, including generating reports, require you to sign in with Google through our authentication provider. You are responsible for maintaining the security of the account credentials associated with your sign-in method and for activity that occurs through your account.
You agree to provide accurate information and to keep your account information current to the extent required to use the service.
4. Credits, billing, and payments
Generating a report consumes one report credit unless we clearly state otherwise for a specific feature, such as viewing a sample report. New accounts may start with zero credits until credits are purchased or granted.
When paid credit purchases are available, payments will be processed through Stripe or another payment provider we designate. Prices, credit pack sizes, taxes, and refund rules will be shown at checkout or in supplemental purchase terms. Unless required by law or stated at purchase, fees are non-refundable once credits are delivered or used.
We may change pricing, credit policies, or free features with reasonable notice where practicable.
5. Acceptable use
You agree not to:
- use Homeward in violation of applicable law or third-party rights;
- attempt to access accounts, data, or systems you are not authorized to access;
- scrape, reverse engineer, or interfere with the service except where permitted by law;
- submit unlawful, harassing, fraudulent, or abusive content through report inputs;
- overload, disrupt, or circumvent usage limits, credit controls, or security measures;
- resell, sublicense, or commercially exploit Homeward or report outputs except as we expressly allow.
We may suspend or terminate access if we reasonably believe you have violated these Terms or created risk for Homeward, other users, or third-party providers.
6. Your content and inputs
You retain ownership of the information you submit to Homeward, including addresses, preferences, and notes. You grant us a limited license to use that information to operate, provide, maintain, and improve the service, including generating and storing reports for your account.
You represent that you have the right to submit the information you provide and that doing so does not violate any law or third-party rights.
7. Homeward content and intellectual property
Homeward, including its software, branding, design, and original content, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited right to use the service as intended, these Terms do not grant you any ownership rights in Homeward.
Reports may incorporate data, maps, and materials from third parties such as Google. Your use of those materials is also subject to the applicable third-party terms.
8. Informational nature of reports
Homeward reports are provided for general informational purposes only. Data about places, schools, clinics, routes, travel times, and neighbourhood conditions may be incomplete, outdated, estimated, or incorrect. Automated summaries may omit important context.
You are solely responsible for verifying all information that matters to your decision, including school catchments and enrolment, daycare availability, healthcare access, commute times, zoning, safety, climate risk, property condition, and contractual obligations related to a move or purchase.
Homeward does not guarantee that any address will meet your needs or that any move will be successful.
9. Third-party services
Homeward depends on third-party providers, including Google Maps Platform, OpenAI, Supabase, and payment processors. We do not control and are not responsible for third-party services, outages, policy changes, or the accuracy of third-party data. Your use of those services may be subject to separate terms and privacy policies.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEWARD IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEWARD AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR CREDITS IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) CAD $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnity
You agree to defend, indemnify, and hold harmless Homeward and its operators from claims, damages, losses, and expenses arising out of your use of the service, your submitted content, or your violation of these Terms or applicable law.
13. Suspension and termination
You may stop using Homeward at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or if we discontinue the service. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnity.
14. Changes to the service or Terms
We may modify Homeward or these Terms from time to time. If we make material changes to these Terms, we will update the "Last updated" date and may provide additional notice where appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms.
15. Governing law
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Courts located in British Columbia will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the service, except where applicable law requires otherwise.
